Currently when you check the box 'Dynamically Set as Default Properties' under the markup tab in the Tools section of preferences it will also update the default Title for every legend after creating a legend from toolbox.
This seems like unintended behavior and makes it difficult to use both features at the same time. I believe a potential fix would be to have legend titles created from toolbox be excluded from affecting the default settings.
